General Data Protection Ordinance & General Terms and Conditions

From May 25, 2018, the new Data Protection Ordinance (DSGVO) comes into force and provides for the uniform regulation of the handling and processing of personal data by companies throughout Europe.

With the entry into force of the General Data Protection Regulation, we are now obliged to inform our customers about the new regulation and to offer you the opportunity to conclude a contract data processing contract with us in accordance with Art. 28 (3).

In addition, we continue to provide you with the opportunity to gain insight into the organizational and technical measures in order to find out about the way in which your data is processed and stored. In order to be able to offer you our services in the future - and as usual - it is necessary that you check the requirements of a contract for order data processing.

What will change for me as a customer of INWX?

Short term: nothing. Your domains will stay registered and your webhosting will still be accessible.

In the long term, under certain conditions, you must conclude a contract data processing contract with us if:

    • Register domains as reseller on behalf of your own customers
    • You use a webspace or mailspace package at INWX
    • You offer commercial content (such as advertising) on your website

A contract data processing contract is not required if you only offer content for your personal and family purposes under your domain and register and manage domains with your own personal information via INWX. The difference between a private and a commercial website is governed by § 5 (1) of the Telemedia Act (TMG).

In addition, we do not want to save more data from INWX than necessary and needed. For this reason, we have decided to expand our terms and conditions to the subsection "deletion of inactive customer accounts". In the future, we will delete accounts that are not used within 12 months.

Inactive INWX accounts are designated as:

    • no login was made within 12 months AND
    • no deposits have been made and there is no balance AND
    • no active domains or other services exists or are used

There is no need for data storage for these accounts, so we will delete this data. You will be informed about the upcoming deletion of the account separately by e-mail and can prevent the deletion by re-login at any time.

This change also comes into effect on May 25, 2018.

What use does the General Data Protection Ordinance have?

The new General Data Protection Regulation aims, on the one hand, to ensure the protection of personal data within the European Union and, on the other hand, to ensure the free movement of data within the European Single Market.

One of the key rights explicitly mentioned in the General Data Protection Regulation is the right to be forgotten. This means that everyone has the right to request the deletion of their data when the reasons for data storage are removed. At the same time, the person who processes and stores the data must delete it without being asked if the reason for the storage is omitted. This means that data can only be processed and stored for a specific purpose.

The general data saving stipulated in the Federal Data Protection Act is replaced by data minimization in the General Data Protection Regulation. This limits the mass processing of data by the General Data Protection Regulation. Another novelty of the regulation is that companies must protect their customers' personal data from unauthorized processing or alteration, data theft or destruction technically and organizationally.

In the course of the General Data Protection Regulation, we have additionally adapted our General Terms and Conditions. Here are some things that will change for you:

4 (old: 3). Duration of contracts and notice periods
The contract is concluded for an indefinite period. The customer is entitled to terminate the contract with a notice period of 4 weeks after a minimum term of 1 month. The Provider is also entitled to terminate the contract with a notice period of 4 weeks. The right of the parties to terminate for good cause remains unaffected. Terminations require the written form to be effective. A tariff change is possible every first of the month. Price changes will be notified by email no later than 2 months before entry into force. If the customer does not object to the validity, then they are considered accepted. Benefits are instantly established.

We reserve the right to delete customer accounts that have not been used within the last 12 months. The customer will be informed in advance by e-mail and asked to avoid deletion by re-logging into his account. If there is no response, the account is deactivated. This only applies to customer accounts that do not contain credit, in which no payments are made and no domains or other services are used.

Our Privacy Policy (https://www.inwx.com) describes how we handle the information you provide us when using our services. You understand that you agree with your use of the services of the collection and use of this information (as set forth in the Privacy Policy).

You may object to the changes in our terms and conditions within four weeks after the entry into force. After the expiry of four weeks, the changed terms and conditions are accepted by you.

Our new terms and conditions will also come into force on May 25, 2018.
